Transparent and effective public investment — #108 Itemized budget for standardized public contracts

Itemized budget should be a part of tender documentation for standardized contracts, in particular for construction contracts. The expected quality of each given item shall be defined by the state, for example, which quality should the surface material of the highway possess. Providing that an itemized budget is well defined, the price should be the main criteria for the assessment of submitted offers. Public contracts should not be artificially divided into smaller ones.

The proposal of the new law on public procurement, which is the Upper Chamber of the Parliament, allows the public contractor to require that the offer takes the form of an electronic catalogue containing itemized prices corresponding to the object of the tendered contract, however, it is not specified that in such a case the price should be the decisive assessment criterion. The prohibition of cutting public contracts of the same character in to smaller pieces exists both in the existing and the proposed law on public procurement, its enforcement is, however, doubtful.
